Two West Lake Hills homeowners have dropped the city from a lawsuit over drainage issues.
Donald and Janice Dempsey of Sundown Parkway had named the city in a lawsuit, along with several adjacent and nearby property owners on Capital of Texas Highway, because they felt they had contributed to drainage issues on their property by violating building codes.
The city argued that it was not involved because the offices causing the damaging runoff were developed before the city annexed them.
The lawsuit against nearby property owners will continue.
“Any time there’s an end to litigation, we’re pretty happy about it,” City Administrator Robert Wood said.
