The retention wall that sparked a lawsuit between a local couple and the city of West Lake Hills has been removed, and city officials say they are on their way an amenable resolution.
“We’re working toward a settlement, and we hope to have an agreement in the near future,” City Administrator Robert Wood said.
Jim and Anne Martin had filed suit against the city when city officials ordered them to tear down a wall built along the sides of a new road across from Laurel Valley Road at the intersection of Yaupon Valley Road. The new street was part of a subdivision originally platted in 1976, called the Roger Wilson Subdivision. Construction on it did not begin until recent years, and the city and couple had signed a short construction agreement to outline the requirements.
When the Martins did not tear down the wall, the city began citing them for work without a permit and the Martins in turn filed suit. In light of the Martins beginning the deconstruction of the wall, the city postponed the Martins’ municipal court date regarding the citations resulting from the wall’s construction.
“The next step should be that our engineer and myself and the city inspector will meet with their engineer and someone to represent Mr. Martin to discuss what needs to be done in that area as far as landscaping and drainage work,” Wood said.
